Energy Law

The field governing the licensing, permitting and contractual dimensions of electricity generation, renewable energy investment and energy trading.

What does this mean, in short?

The field governing the licensing, permitting and contractual dimensions of electricity generation, renewable energy investment and energy trading.

Energy law is heavily regulated: generation requires a license, land requires an easement, grid connection requires a call letter, and operation requires a string of permits. Missing even one can halt an entire project.

In Turkey, the sector's framework is set by Electricity Market Law No. 6446 and EMRA regulations. For renewable investments, the YEKDEM support mechanism and YEKA (renewable energy resource zone) mechanisms are also decisive.

SBP Legal manages the legal process for developers, investors and financiers on solar, wind and hybrid projects, from licensing through to commissioning.

What we do in this area

Does this page speak to your situation?

If any of the following applies to you, now is the time to talk:

  • You're planning a rooftop or ground-mounted solar investment.
  • You're buying or selling a licensed power plant.
  • You've received notice of an EMRA administrative fine.
  • You want your company to buy electricity directly from a producer through a corporate PPA.

Frequently asked questions

Does every solar investment need a license?

No. Facilities below a certain installed-capacity threshold are treated as unlicensed generation and can be built through a shorter permitting process. Projects above the threshold must obtain a generation license from EMRA. Because the thresholds change over time, current regulations should be checked before any investment decision.

What is a corporate PPA?

It's when a company buys its electricity directly from a renewable power plant under a long-term contract, rather than from the exchange or a supplier. It offers price predictability and carbon-reporting advantages, but requires careful drafting of production risk, imbalance cost and force majeure clauses.

What's the most commonly missed risk in a plant transfer?

Whether the connection agreement, land easement and EIA decision remain valid after the transfer. License transfers require EMRA approval; share movements made without that approval can end up invalidating the license.
